Due to
the very high volume of calls and emails for reproduction use please
read
the below notice before you submit
a request for any reproduction use of any image viewed on this website.

Joseph Gallery SELLS ONLY PRINT reproductions of the images represented
herein.
The Gallery
DOES NOT RESPOND to any telephone requests FOR USE OF IMAGES for
commercial or private use.
DO NOT
CALL the Gallery to request the use of the images.
The
Gallery DOES NOT OWN THE COPYRIGHTS OF THE IMAGES.
If you
buy a print from the Gallery, you may display it, but not reproduce
it in any way. That's just a basic copyright law. Please read Terms
of Use below.
ONLY
the COPYRIGHT OWNER can give permission to use the images in any
way.
This
is a print gallery, not a commercial stock agency. Dozens of emailed
requests a week are received with vague descriptions. The Gallery
Does Not Reply. The Gallery may forward them IF you make it easy
.
If you
want direct contact with the copyright holder, try a Google search,
try ( Geddis Photographer ), or dial 411, but not the Gallery.
If your
emailed request has identified a photographer, ( First word of every
title is the artist's last name), ( ONLY ONE PER EMAIL REQUEST),
and the copyright holder can be reached by email, then the request
may be forwarded to the copyright holder.
Since
ONLY the COPYRIGHT OWNER can give permission to use the images,
if they Don't reply, it means they have NOT given you permission.

to abide by and to be legally bound by the terms and conditions,
disclaimers , and notices, (also designated as the agreement), we
have established and outlined below. If you do not agree to abide
by and to be legally bound by the agreement we have established,
you may not access or otherwise use the Site.
The Site is owned and administered by Arts Pacific, Incorporated
dba William Joseph Gallery, (also designated as "our", "we", and
"Arts Pacific, Inc."). All Content is protected by US and international
copyright laws. All Site design, graphics, and image samples of
photographs, (the Content) are Copyright © 1999-2000, Arts Pacific,
Inc., or by our contributing photographers. The Site's Image Samples
may be both visually and digitally Copyright Notice watermarked.
You can
view the Site's promotional Image Samples of photographs, ( the
Image Sample(s)), for your personal, noncommercial use only. This
means that you can view the Image Samples on your computer. You
agree that you do not obtain any ownership rights by retaining any
copyrighted material. You are required to conform with all relevant
laws, regulations and rules regarding your use of copyrighted material.
You cannot not distribute, create derivative works from, participate
in the transfer or sale of, post on the World Wide Web, reproduce,
transmit, or in any other way exploit the Image Sample(s) or any
portion thereof for any public or commercial use. Specifically,
you cannot include the Content in another publication or product,
or on another Web site, or computer network. All rights are reserved,
and these Image Samples are for review only. All photographs exhibited
on this Site are copyrighted by the contributing photographers and
are used by Arts Pacific, Inc. pursuant to express authorization
from the copyright owners that permits Arts Pacific, Inc. to transmit
Image Samples solely for the purpose of promotion of sales of the
photographs. Any use of the images, including the reproduction,
modification, or distribution, without the prior written permission
of the owner of the Copyright, is prohibited. You have to abide
all other conditions, terms, and restrictions contained in any other
agreement associated with the Content in the Site. You are bound
by this agreement when you access the Site and until you have deleted
all Content that you have retained from the Site; you are also bound
by this agreement whether you retained the Content under the terms

Inc. is committed to respecting your privacy. We do not rent, lease

third parties. In some instances, a copyright holder may be supplied
with the account information related to the purchase of their copyright
artwork(s) solely for internal audit purposes. We may analyze aggregate
data that is anonymous and contains no personal information that

do identify a user's computer. When you request our assistance via
email, telephone, mail, or fax , or when you make a purchase, you

of use are in force will be considered acknowledgement of those
changes. Price and availability information is subject to change
without notice.
You agree that your use of the Site is at your own risk. In the
event that you experience unsatisfactory results with the Site,
or any components of the Site, your only redress is to stop accessing

You shall indemnify, defend and hold harmless Arts Pacific, Inc.,

providers, affiliates, licensors and licensees (collectively, the
"Indemnified Parties") from and against any and all losses, damages,
liabilities, and claims and all fees, costs, expenses, of any kind
related thereto (including, without limitation, reasonable attorneys'
fees) incurred by the Indemnified Parties in connection with any
claim emerging out of, or resulting from your use of the Site. Under
no circumstances can the total liability to you for any and all
losses, damages, and causes of action, ( in tort or contract), emerging
from your use of the Site or the Site's terms and conditions of
use surpass, in the combined total, $101.00 (US). Neither Arts Pacific,
Inc., nor any contributing photographers will be liable or responsible
to you for any direct, incidental, consequential, indirect, or punitive
damages that may arise from, or result from your access to or use,
or the incapability to use, the Content, services, and components
on the Site, including without limitation forfeited business, revenue,
or expected profits. Title of merchandise shipped to buyers, wherever
they may reside shall pass to the buyer upon delivery of the merchandise
to the common carrier.

Arts Pacific, Inc. makes no warranties of any kind, either express
or implied, including but not limited to: suitability for a specific
purpose, implied warranties of merchantability, or non-infringement

This agreement is governed by the laws of the State of Oregon, United
States of America, without giving effect to any principles of conflicts
of law. The sole and exclusive jurisdiction for any action or proceeding
arising out of or related to this agreement shall be an appropriate
State or Federal court located in Multnomah County in the State
of Oregon and you hereby irrevocably consent to the jurisdiction
of such courts. If for any reason a court of competent jurisdiction
finds any provision of this agreement, or portion thereof, to be
unenforceable, that provision shall be enforced to the fullest extent
permissible so as to effect the intent of this agreement, and the
remainder of this agreement shall continue in full force and effect.
All the terms and conditions, disclaimers, and notices described
above represent the entire agreement between you and Arts Pacific,
Inc., regarding your relationship with Arts Pacific, Inc. and the
Site, and supersedes any previous representations or statements.
No waiver by either you or Arts Pacific, Inc. of any breach or default
hereunder shall be deemed to be a waiver of any preceding or subsequent
breach or default.
